1 · Scope

The site is for entertainment only. Neon Vibe Zone ("we", "us", or the "Site") provides social casino-style games for entertainment only. The Site does not offer real-money gambling, betting, wagering, sweepstakes, contests, drawings, raffles, prize promotions, or any mechanic by which virtual currency can be exchanged for anything of monetary value.

2 · No real-money gambling

Nothing on the Site involves real money. You acknowledge and agree that:

• You do not wager real money on the Site.
• You cannot win real money or anything of monetary value.
• You cannot win prizes, gift cards, cryptocurrency, merchandise, or rewards of any kind.
• You cannot redeem virtual coins, chips, credits, points, or any in-game item for cash, prizes, gift cards, cryptocurrency, or anything of monetary value.
• You cannot cash out, withdraw, sell, transfer, or exchange virtual coins or any in-game item.
• You cannot participate in sweepstakes, contests, raffles, drawings, prize promotions, or any equivalent mechanic on the Site.

3 · Virtual currency

Virtual coins are non-redeemable entertainment credits. Virtual coins, chips, credits, bonuses, and other in-game items (collectively, "Virtual Items") are licensed to you for entertainment use only and remain the property of Neon Vibe Zone. Virtual Items have no cash value and cannot be sold, transferred, withdrawn, exchanged, or redeemed for cash, prizes, gift cards, cryptocurrency, or anything of monetary value. Virtual Items are not money, not a stored-value instrument, not a security, and not a financial product of any kind. They confer no ownership right in Neon Vibe Zone.

4 · No purchase required

You never have to pay to play. No purchase is required to use the Site or to obtain Virtual Items. Neon Vibe Zone does not sell virtual coins. The starter balance and the daily refill are free. If optional virtual credit packs are offered in the future, any purchase would be optional, would buy entertainment credits only, would have no cash value, and would be final except where the law requires a refund.

5 · Eligibility

21+ only. You must be at least 21 years old to access or use the Site. By joining, you confirm that you are at least 21 years old and that your use of the Site is lawful where you live. Access may be unavailable where the law does not allow it.

6 · Account and conduct

Sign-in uses a one-time email code. You are responsible for the email address and phone number you submit and for activity on this browser under your member profile. You agree not to: (i) attempt to obtain Virtual Items by fraudulent or automated means; (ii) sell, trade, or transfer your profile or Virtual Items; (iii) misrepresent your age, identity, or state; (iv) use the Site in a manner that violates applicable law. Neon Vibe Zone may refuse or end access for abuse or a violation of these terms.

7 · Restricted states

The Site is not available to residents of Washington, Idaho, Michigan, Nevada, or Montana, or anywhere else the law prohibits it. During sign-up you select your state, and those states are refused. Neon Vibe Zone may refuse access where the law requires it.

8 · Intellectual property

The name Neon Vibe Zone, the emblem, room names, artwork, and code are original to this Site and are protected by intellectual property laws. You receive a limited, revocable, non-exclusive licence to use the Site for personal, non-commercial entertainment only.

9 · Disclaimers and limitation of liability

The Site is provided "as is" and "as available." Neon Vibe Zone disclaims warranties to the fullest extent permitted by law. Neon Vibe Zone is not liable for indirect, incidental, consequential, special, or punitive damages arising out of your use of the Site. Because the Site involves no real money, no Virtual Item has cash value, and no prizes exist, a lost virtual balance has no monetary value.

10 · Changes

We may update these terms from time to time. The "Last updated" date at the top of this page shows the latest revision. Continued use of the Site after a change means you accept the revised terms.

11 · Governing law

These terms, and any dispute arising out of them or the Site, are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where the law of your state does not allow that choice. They are not an offer in a restricted state.

12 · Dispute resolution

Please read this section carefully. It asks you to resolve most disputes through binding individual arbitration rather than in court, and it limits class actions.

Agreement to arbitrate. You and Neon Vibe Zone agree that any dispute, controversy, or claim arising out of or relating to these terms, your use of the Site, or our relationship (a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, available at adr.org, except as stated below. The arbitrator's award is final and binding and may be entered as a judgment in a court of competent jurisdiction.

Exceptions. Either party may bring an individual claim in small-claims court if the claim qualifies and stays an individual action. Either party may seek emergency injunctive relief in court to prevent irreparable harm while arbitration is pending. All other Disputes must be arbitrated.

Class action waiver. You and Neon Vibe Zone agree that Disputes will be resolved only on an individual basis and not in a class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over a class or representative proceeding. If a court finds this waiver unenforceable for a particular claim, that claim alone may proceed in court. The other claims stay in arbitration.

Procedures. The arbitration will be in English. You may take part by videoconference, telephone, or written submission. If an in-person hearing is required, it will be in the county of your primary residence or, if you choose, in Wilmington, Delaware. Neon Vibe Zone will pay AAA filing, administrative, and arbitrator fees for claims that do not exceed US $10,000, unless the arbitrator finds the claim frivolous.

Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these terms by emailing [email protected] with the subject line "Arbitration Opt-Out." Include your name, email address, and a clear statement that you wish to opt out. If you opt out, Section 11 still applies.

13 · Severability

If any provision of these terms is unenforceable, that provision will be severed and the remaining provisions will stay in effect.

14 · Entire agreement

These terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and Neon Vibe Zone about your use of the Site.
